23 - Responsibility for Vehicle Condition

Before the journey begins, the driver must ensure that the vehicle is in a safe and regulatory-compliant condition and that it is safely and properly loaded. The driver must also ensure that the vehicle remains in a safe condition and properly loaded throughout its use.

The owner of the vehicle or the person who has control of the vehicle on behalf of the owner must ensure that the vehicle is not used if it is not in a safe condition.

In transport assignments, the transport company must ensure that the driver is able to fulfill their duties under the first paragraph, so that the vehicle is safely and properly loaded. The Ministry may issue regulations specifying further duties for transport companies, including specific regulations for certain types of vehicles.
