22c - Customs Authority Testing of Impairment
The Customs Authority may conduct an alcohol test (preliminary breath test) and a preliminary test to determine if the motor vehicle driver is impaired by any other intoxicating or sedative substances when the motor vehicle is stopped in a control under the provisions of the Goods Transport Act § 8-1 first paragraph, cf. § 8-2 letter b.
If the test result gives reason to believe that the driver of the motor vehicle has violated the provisions of § 22, the police must be immediately notified. The Customs Authority may detain the driver using force if the driver attempts to evade testing or until the driver is handed over to the police. The use of force must be necessary and proportionate to the seriousness of the situation, the purpose of the service action, and the circumstances otherwise.
