13 - Requirements for Vehicles and Use of Vehicles
Vehicles must be constructed, arranged, equipped, and maintained in such a way that they can be used without causing unnecessary danger or inconvenience, and without damaging the road.
The Ministry shall issue further regulations regarding the use, and the construction, arrangement, weight, dimensions, and equipment, including protective equipment, etc., for different categories of vehicles, as well as the load and number of people the vehicle can carry.
The Ministry may issue regulations requiring vehicles with a permissible total weight over 3,500 kg to be equipped with an electronic payment device connected to a valid agreement for driving on public roads. The Ministry may issue further provisions regarding the scheme, including provisions regarding its scope and which categories of vehicles will be included.
The Ministry may establish regulations requiring vehicles to be equipped with a tachograph to register driving and rest times, working hours, holiday and sick leave, speed, vehicle positions, including border crossings, loading and unloading, etc., cf. ยง 21 second paragraph. Such records may be used to control compliance with rules established under or in accordance with this law, the Professional Transport Act, the Working Environment Act, and the General Application Act. The Ministry will issue further provisions regarding the approval, installation, and inspection of tachographs. The costs for the purchase, installation, and inspection of tachographs shall be covered by the vehicle owner.
Modifications that increase the maximum speed or performance of a motorcycle (including mopeds) beyond the limits established for the relevant category of motorcycles under the second paragraph may not be made.
With the consent of the Ministry, a municipality may introduce a fee for the use of studded tires in a specifically designated area. The Ministry may issue further provisions about such a measure. The Ministry may require a municipality to implement a scheme as mentioned in this paragraph.
With the consent of the Ministry, a municipality may, in order to reduce environmental disadvantages from road traffic, introduce a low-emission zone in a designated area. The Ministry may issue further provisions on the obligation to carry documentation of the vehicle's emission levels, the right to request and store vehicle information and information about the owner and user, etc., for use in payment and control contexts, including the right to require the use of an electronic device onboard the vehicle for electronic identification. The Ministry may issue provisions regarding a fee for driving in the zone, additional fees for violations of the regulations, and provisions on enforcement and use of the income from the scheme.
