36 - Fee for Violations of Regulations on Permitted Weights and Dimensions
The owner of a vehicle, transporter, or sender who significantly violates or contributes to a significant violation of regulations on permitted weights and dimensions may be subject to a fee.
In cases of violations that result in fee liability under the first paragraph, the police or the Norwegian Public Roads Administration (Statens vegvesen) may take the vehicle into custody at the expense and risk of the responsible party or prohibit its use until the fee and any associated costs related to the custody are paid or sufficient security for the claim is provided as mentioned in the Enforcement Act § 3-4. Custody and prohibition of use may, if necessary, be enforced using mechanical or electronic devices. Any imposed fee may be appealed to the District Court under the rules in § 31 a, fourth paragraph.
The fee constitutes an enforceable basis for collection, including against the vehicle owner, cf. § 38, second paragraph. The provisions in the second paragraph, first sentence, may also apply to the vehicle, which serves as security under the provisions of § 38, first paragraph.
The Ministry may issue regulations concerning: a. Weighing, measuring, and relevant documentation from the sender, as well as the access of control authorities to such documentation, b. The obligation to drive to a designated inspection site, c. Fee rates, including higher rates for repeated violations, d. The imposition, payment deadlines, and enforcement of fees, e. The complaints process and deadlines for appeals, f. The authority to waive fees in exceptional cases, and g. Revocation of license plates and documents in cases mentioned in the second paragraph.
